March 9, 2021. OnPoint expert Dr. Vivek Shah recently gave a full day of deposition testimony in a class action lawsuit against Defendant LexisNexis Risk Solutions, Inc. (“LNRS”), a consumer reporting agency (Theresa Hill et al. v. LexisNexis Risk Solutions, Inc., USDC, Western District of Missouri, Case No. 4:18-00560-CV-RK). Dr. Shah served as an economic expert on behalf of Plaintiff Theresa Hill and those similarly situated. The case involves allegations that LNRS violated the Fair Credit Reporting Act (“FCRA”) by failing to keep consumers’ civil judgment data up-to-date. Throughout the litigation, LNRS has maintained that it does not maintain frozen scans of what a consumer’s file looked like at a given time. Further, Defendant sought to exclude the public records data that was collected from courts across the country and sold to one of the largest nationwide consumer reporting agencies. Plaintiff sought this data as an alternative means from which to identify a Class. United States District Judge Roseann A. Ketchmark relied on Dr. Shah’s opinion justifying Plaintiffs’ discovery request and ordered Defendant to produce the entire set of data files requested. Dr. Shah has provided three experts reports on the matter. The case is ongoing.
