OnPoint Expert Helps to Secure Class Certification in Juul Antitrust Case

On February 5, 2026, U.S. District Court Judge William H. Orrick certified a class of indirect purchasers of Juul pods in the case In Re: Juul Labs, Inc. Antitrust Litigation. The case involves an alleged unlawful partial acquisition of Defendant Juul Labs, Inc. by Defendants Altria Group, Inc. and Altria Enterprises LLC (collectively “Altria”), which are electronic cigarette manufacturers, in exchange for Altria exiting the market.

OnPoint expert Dr. Gareth Macartney, in his expert reports and subsequent deposition, opined that a common methodology can be used to calculate class-wide damages resulting from the alleged anti-competitive deal.
