OnPoint expert, Dr. Stephen Hamilton, recently testified as an expert witness on the topic of economic damages for Plaintiffs in a deceptive pricing class action lawsuit against Carter’s, Inc. The Defendants are alleged to have engaged in the false and misleading advertisement of “market” prices (and corresponding phantom “savings”) on children’s apparel and accessories sold in their Carter’s and OshKosh B’gosh stores. For example, Plaintiffs allege that Defendants prominently displayed “50% off” various items throughout the stores even though the items never sold at the advertised “market” price. In March, Dr. Hamilton filed an expert report on the topic of feasible damage methodologies that could be applied in this case. His recent testimony relates to that report. The case is ongoing.
